Terms of Service

These Terms of Service ("Terms") govern your access to and use of LeaseRadius ("LeaseRadius," "we," "us," or "our"), an AI-powered marketing service for multifamily residential properties operated by LeaseRadius LLC. By creating an account or subscribing to a property, you ("Customer," "you") agree to these Terms. If you do not agree, do not use the service.

1. The Service

LeaseRadius provides software that uses AI agents to research neighborhood signals, build renter personas, and generate and publish social media posts and SEO blog content for residential apartment properties. Specific deliverables for each subscription tier are described on our pricing page and may evolve over time.

2. Eligibility & Account

You must be at least 18 years old and authorized to enter into a contract on behalf of any property you add to LeaseRadius. You are responsible for all activity under your account, for keeping your credentials confidential, and for ensuring that any person you invite to your account complies with these Terms.

3. Subscriptions, Pricing & Billing

Subscriptions are sold on a per-property basis. The current monthly price is $499 per property per month for the Visibility tier, and $299 per property per month for the Small Property tier (available to communities with fewer than 30 units), billed in advance through Stripe. Your subscription automatically renews each month until cancelled.

If you redeem a valid promotional code, any discount applies for the duration shown at checkout. After the promotional period ends, you will be charged the standard monthly rate automatically using the payment method on file unless you cancel beforehand.

You authorize us, through Stripe, to charge your payment method for all fees due. Failed payments may cause your subscription to lapse and your agents to stop running.

4. Cancellation & Refunds

You may cancel a property's subscription at any time from your dashboard. Cancellation stops future billing; you will retain access through the end of the period you have already paid for. Except where required by law, fees already paid are non-refundable. Promotional periods that have not yet ended carry no cash value.

5. Your Content & Licenses

You retain ownership of any photos, text, logos, branding, property data, and other materials you submit to LeaseRadius ("Customer Content"). You grant LeaseRadius a worldwide, non-exclusive, royalty-free license to host, process, transmit, and use your Customer Content as needed to operate the service for you, including making it available to the third-party services described below.

You represent that you have the rights necessary to grant this license, that your Customer Content does not infringe any third party's rights, and that you have obtained any consents required to submit photographs containing identifiable people.

6. AI-Generated Content

LeaseRadius uses third-party large language models and other AI systems to draft social posts, blog content, and analyses. Subject to your payment of fees, LeaseRadius assigns to you all rights it has in the AI-generated content created specifically for your property, so that you may use it as if you had created it. You acknowledge that AI output can contain inaccuracies and that you are responsible for reviewing content before publication where review workflows are available.

7. Acceptable Use & Fair Housing

You will not use LeaseRadius to publish content that is unlawful, defamatory, fraudulent, infringing, or that violates any third party's privacy or publicity rights. Because LeaseRadius markets residential housing, you specifically agree to comply with the federal Fair Housing Act, applicable state and local fair housing laws, and platform advertising policies, including prohibitions on discrimination based on race, color, religion, national origin, sex, disability, familial status, or any other protected characteristic. You are responsible for ensuring that any content published from your property is fair-housing compliant.

8. No Outcome Guarantees

LeaseRadius does not guarantee any specific result, including (without limitation) lead volume, lease signings, occupancy, social media engagement, follower growth, or search engine ranking. Marketing outcomes depend on many factors outside our control.

9. Third-Party Services

LeaseRadius is built on, and integrates with, third-party services we use to deliver the product, including hosting, payment processing, publishing, location data, and AI model providers. Where you connect an account of your own, such as Instagram, Facebook, or your Google Business Profile, you authorize LeaseRadius to act on your behalf on that platform through that platform’s official sign-in, and you may revoke that authorization at any time. Our handling of data received from Google APIs is described in Section 5 of the Privacy Policy. Your use of LeaseRadius is also subject to those providers’ own terms with respect to data passed through their systems. We are not responsible for outages or behavior of those providers but will use commercially reasonable efforts to keep the service running. A current list of sub-processors is available on request.

10. Service Availability

We use commercially reasonable efforts to keep LeaseRadius available, but the service is provided "as is" and we do not currently offer a service-level agreement. We may modify, suspend, or discontinue features at any time, generally with notice for material changes that affect paying customers.

11. Suspension & Termination

We may suspend or terminate your access if you violate these Terms, fail to pay fees, or use the service in a way that exposes us or third parties to legal or operational risk. Upon termination, your right to use LeaseRadius ends, but provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will remain in effect.

12. Disclaimers

EXCEPT WHERE EXPRESSLY STATED, LEASERADIUS IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEASERADIUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, EVEN IF FORESEEABLE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO LEASERADIUS IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You will defend, indemnify, and hold LeaseRadius and its affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of Customer Content you submit, content published from your property, your violation of these Terms, or your violation of any law or third-party right.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The parties will attempt to resolve any dispute informally first by contacting us at contact@leaseradius.ai. If a dispute cannot be resolved informally, exclusive jurisdiction lies with the state or federal courts located in San Diego County, California, and the parties consent to personal jurisdiction there.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the service. Continued use of LeaseRadius after the effective date of an update means you accept the updated Terms.
